These Terms of Service govern your use of our website, Vivedmark.shop, and our video editing services, including our Essential Edit Package ($150), Standard Edit Package ($250), Premium Edit Package ($350), and Elite Edit Package ($450). By booking our services or accessing our website, you agree to these terms, which outline the expectations, responsibilities, and agreements for our collaboration. We use industry-standard tools like Adobe Premiere Pro and Adobe After Effects to deliver high-quality videos, and we aim to ensure a seamless experience for all clients.
Services Provided
Vivedmark.shop offers professional video editing services tailored to your needs, as described on our website. Each package includes specific features, such as editing, color grading, visual effects, and revisions, with clear deliverables and turnaround times. You agree to provide accurate project details and usable raw footage (e.g., via secure cloud links like Dropbox or Google Drive) to enable us to fulfill your order. We reserve the right to decline projects that involve unlawful or inappropriate content, ensuring all work aligns with legal and ethical standards.
Payment Terms
Payments for our services are processed securely through Stripe, our trusted payment provider. Full payment is required upfront for the Essential Edit Package ($150). For the Standard, Premium, and Elite packages, a 50% deposit may be required at booking, with the balance due before final video delivery. All prices are in USD, and you are responsible for any applicable taxes or fees. If payment is not received as agreed, we may pause or cancel your project, and no final deliverables will be provided until payment is completed.
Revisions and Approvals
Each package includes a set number of revisions to ensure your satisfaction: one for Essential, two for Standard, three for Premium, and unlimited (within 10 days) for Elite. Revisions must be requested within seven days of receiving a draft video and should align with the original project brief. Additional revisions beyond the package limits may incur extra fees, agreed upon in advance. Once you approve the final video, it is considered complete, and no further changes can be made under the original agreement.
Intellectual Property
You retain ownership of the raw footage you provide for editing. Upon full payment, you receive a non-exclusive license to use the final edited video for personal or commercial purposes, as applicable. Vivedmark.shop retains the right to use the final video in our portfolio or promotional materials, unless you request otherwise in writing before project completion. We may use royalty-free music, effects, or assets in your videos, ensuring compliance with licensing terms. You are responsible for ensuring your raw footage does not infringe on third-party intellectual property rights.
Cancellations and Refunds
You may cancel your project within 24 hours of booking at no cost, with any payments or deposits fully refunded via Stripe. After editing begins, partial refunds may be issued based on work completed, as outlined in our Refund Policy and Cancellation Policy. No refunds are available after final video delivery and approval. To cancel, contact us via our website, email, or phone, and we will process your request promptly.
Delivery and Turnaround Times
We strive to deliver your edited video within the estimated turnaround times: 3–5 days for Essential, 5–7 days for Standard, 7–10 days for Premium, and 10–12 days for Elite. These timelines begin once we receive usable footage and a complete project brief. Delays caused by incomplete submissions or external factors (e.g., technical issues with footage) may extend delivery times, and we will communicate any changes promptly. Final videos are delivered in the formats specified in your package (e.g., MP4, MOV, or ProRes).
Limitation of Liability
Vivedmark.shop is committed to delivering high-quality video editing services, but we are not liable for issues beyond our control, such as corrupted or unusable footage, client delays, or third-party service interruptions (e.g., cloud storage issues). Our liability is limited to the amount paid for the service. We are not responsible for any indirect or consequential damages, such as lost profits or missed deadlines, arising from the use of our services or website.
Client Responsibilities
You agree to provide accurate, complete, and timely information, including raw footage, project briefs, and payment details. You warrant that all materials you submit are lawful and do not infringe on third-party rights. Failure to provide usable footage or clear instructions may result in project delays or cancellation without refund. You are responsible for reviewing drafts and providing feedback within the specified timelines to ensure timely delivery.
Governing Law
These Terms of Service are governed by the laws of the State of Texas, USA. Any disputes arising from our services will be resolved through negotiation or, if necessary, in a court of competent jurisdiction in Houston, Texas. You agree to attempt good-faith resolution with us before pursuing legal action.
